The U.S. government is considering a number of options for responding to national security concerns related to the TikTok app, including a ban on the app and a number of other measures. U.S. law and regulation could apply to TikTok if a U.S. company were to acquire its U.S. operations, an idea that has been discussed. In this way, TikTok could stay in business in the United States while calming fears of interference from the Chinese government.
According to reports, Microsoft and ByteDance have been in acquisition talks for TikTok’s U.S. operations and have until September 15 to come to terms. Microsoft said in a statement that “subject to a complete security review and providing proper economic benefits to the United States, including the United States Treasury,” it is “committed to acquiring TikTok.” Whether or not the Trump administration or CFIUS would approve of such an acquisition is, however, unknown.
TikTok’s U.S. operations could be supervised by a government-run trust, another option being considered. The U.S. government would appoint a board of trustees to oversee TikTok’s trust holding its U.S. operations to ensure it complies with national security regulations under this plan. With this method, TikTok could keep operating in the United States while also being subject to more scrutiny and receiving more assurance that it is not being used for illegal activities.
TikTok continues to raise concerns due to its potential effects on national security, which has led to the introduction of legislation to ban the app and discussions about possible acquisitions or trusts. TikTok has denied wrongdoing and promised to address government concerns, but the app’s future in the United States is still up in the air.
